1. Welcome to Produzioni dal Basso

Produzioni dal Basso offers the opportunity to create and support different types of fundraising and crowdfunding projects with different conditions.

Founded in 2005 Produzioni dal Basso (“PDB”) is a crowdfunding platform that allows fundraising for specific projects by anyone who wants to support them, in a simple, horizontal and transparent way.

Produzioni dal Basso offers the opportunity to create and support different types of fundraising and crowdfunding projects with different conditions.

Supporters are invited to carefully evaluate a project, choosing with full responsibility whether and how to support it; in particular, Supporters should verify the exact proposals, the existence of rewards or counter-rewards, and the terms and conditions of the project.
In addition, all Supporters are invited to participate in community activities, such as sharing ideas, considerations and comments on each project.

PDB does not acquire rights to the proposed works, does not promote the projects, or distribute any goods. Consequently, PDB does not hold any responsibility for the projects present on the platform; PDB is a service provider for those who propose the project and for those who intend to fund it.

To support a project, simply register on the site using a valid email and password. You will then be guided through the Donation process and the agreement with the project Creator.

No contractual relationship is created between PDB and Supporters, but only between Supporters and Creators. Each Donation entails full and complete acceptance of the terms and conditions offered by the project author, in the version in effect at the time the Donation is made.

2. Service contract for Creators

Before creating your project on PDB you must read and agree to the following terms of use.

The provision of services by FOLKFUNDING s.r.l. through the crowdfunding platform "Produzioni dal Basso" (hereinafter: PDB) in favor of the person who wants to propose a crowdfunding project (hereinafter: Creator) is subject to the following terms and conditions.

  1. To use PDB, an account must be created on the platform

    The Creator accesses PDB’s services by creating an account, that is, by registering on the website www.produzionidalbasso.com (hereinafter: Site) and obtaining a "User Name" and a "Password." After which, the Creator is asked to accept this Service Agreement. Upon registration, the Creator may use the Site to build their crowdfunding project (hereafter: Project) according to one of the models described below. PLEASE NOTE, in order to preserve the interests of all users and Supporters, PDB has the right to suspend or delete an account at its discretion upon abuse or violation of Site Policies.

  2. You must be 18 years old or older and can be credited as an individual, association or company

    The Creator is identified in the account registration process as an individual, company or legal entity. The Creator represents and warrants that the registrant is an individual of legal age and possesses all necessary legal powers.

  3. PDB shall maintain data in compliance with applicable law, the Creator agrees to properly guard the secrecy of his/her account credentials and to make copies of project materials uploaded to the platform

    The Creator agrees to diligently safeguard the login credentials and arrange for back up of all uploaded content. For this reason, the Creator releases PDB from any liability in this regard (for e.g., but not limited to: breach of credentials, unauthorized access, unauthorized extraction of data and information, alteration of data or information, obscuration of web pages, etc.). In any case, PDB is authorized to keep navigation logs in accordance with its current Privacy Policy and to suspend the account in case of abuse of the pages.

  4. The Creator is responsible for the use of personal and/or sensitive data of Supporters that it comes into possession of

    During the fundraising campaign, the Creator will come into possession of information such as first name, last name, e-mail address, and physical address of each individual Supporter. The Creator, by accepting these Terms of Use, expressly indemnifies FolkFunding s.r.l., as owner and manager of the platform produzionidalbasso.com, from any violation, or improper use, of such data and information, or where the same are used for purposes unrelated and/or unlawful with respect to the "Terms of Use" and the "Terms and Conditions of the contract between Supporter and Creator", assuming full liability in civil and criminal law arising from unlawful and improper use of such information.

  5. Projects are uploaded independently and the Creator guarantees the truthfulness and feasibility of the project and ownership of the necessary rights to the proposed ideas, images and other materials used in their project

    The Creator proceeds independently with the publication of the Project on the Site, by using only the upload forms offered by the Site. The Creator is solely responsible for the files, images, and content published and expressly releases PDB from any liability in relation to the legitimacy, correctness, cost-effectiveness, and convenience of the Project. The Creator agrees to upload files and documents that are free of viruses, and otherwise unfit to compromise, to any extent, the hardware or software of those who view or download them. The Creator agrees to upload images and/or videos that are lawful, relevant to, or descriptive of the Project, compatible with an ordinary assessment of morality and decency, and free of connotations of political and religious propaganda, violence or pornography. The Creator undertakes to upload only images and/or videos (hereinafter: “Media”) for which they have the relevant valid rights of use, or Media that does not constitute an infringement of third party rights. The Creator declares that the Project is their property and that it does not constitute an act of unfair competition against third parties. The Creator agrees not to publish data, news, or information in any way likely to unlawfully infringe upon the rights or interests of third parties.

  6. List of project categories that are not accepted on PDB

    The Project shall in no way offer the sale, lease, donation, brokerage, or other services of any kind in the following areas:

    1. Illegal drugs

    2. gambling or betting

    3. Tobacco products (including, but not limited to: cigarettes, vapes and e-cigarettes)

    4. Weapons of any kind and related accessories

    5. Pornographic or sexual products or services

    6. Pharmaceutical drugs

    7. Stocks, bonds, currencies, financial instruments or securities of any kind

    8. Products or services likely to violate the law or regulatory or administrative measures

    9. Dangerous products or services

    10. Products or services that infringe the intellectual property of third parties

    11. Products or services whose distribution is subject to licenses or administrative authorizations of any kind

  7. In addition to the above categories, PDB reserves the right to refuse projects not deemed suitable

    In any case, PDB reserves the right to refuse to publish the Project or suspend the campaign, when the products or services offered by Creator are not compatible with PDB's image, reputation and/or ethics.

  8. PDB offers different models of fundraising and crowdfunding

    When uploading a Project, the Creator must choose one of the following crowdfunding models:

    1. ALL OR NOTHING MODEL

    2. KEEP IT ALL MODEL

    3. DONATION MODEL

  9. In the ALL OR NOTHING model, a Goal and Deadline are set for the Project, Supporters will provide payment information through our system (PAYPAL or LEMON WAY), but won’t be charged. Payment will only be collected if, at the time of the Project’s deadline, the Project has reached its fundraising goal

    By adopting the ALL OR NOTHING MODEL, the Creator can offer Supporters with rewards, in proportion to the pledged donation. In this case, the Creator must indicate:

    • the "Goal" they intend to raise;

    • the "Deadline" i.e., the duration of the campaign.

    At the time of Donation, the pre-selected payment service provider may verify the existence of funds, but not charge or place a hold on the Supporter's account.
    If the Goal is not reached by the Deadline, the Creator is not entitled to any payment and all Donations become ineffective.
    Whereas, if the Goal is reached or exceeded by the Deadline, the Creator is entitled to the payment of the collected amount, minus the Payment Fees specified below and a fee in favor of PDB equal to 5% including VAT for each payment.
    If the Supporter's payment method of choice has become insufficient in the meantime, no commission will be credited in favor of the Creator or charged to anyone. The system will send reminders to the defaulter and proceed with withdrawal attempts within days after the Deadline.

    A Supporter who fails to settle the Donation using the previously authorized method of payment has the option to update the payment method or change it and settle the Donation.

    Under no circumstances can PDB be held responsible for failure to charge Donations.

  10. In the KEEP IT ALL model, a Goal and a Deadline are chosen, and the funds raised immediately become available to the Creator

    By adopting the KEEP IT ALL MODEL, the Creator can offer symbolic, digital or in-kind rewards to Supporters in exchange for donations, being able to modulate the type of reward from a minimum of zero to a maximum equivalent to the value of the Donation.
    In this case, the Creator must indicate:

    1. the "Goal" they intend to raise;

    2. the "Deadline" i.e., the duration of the campaign.

    Regardless of the Deadline and even if the Goal is not reached, the Creator is entitled to the payment of the amount raised, minus the Payment Fees specified below and a commission in favor of PDB equal to 5% including VAT for each payment. Said payment is made promptly for each subscription, within the timeframe offered by the payment service provider, PAYPAL or LEMONWAY, without waiting for the Deadline.

  11. In the DONATION model, only a deadline is given, and the funds collected are immediately available to the Creator

    By adopting the DONATION MODEL, the Creator either offers no rewards, or offers Supporters minimal or merely moral rewards.
    In this case the Creator must indicate:

    1. the "Deadline" i.e., the duration of the campaign.

    Regardless of the Deadline, the Creator is entitled to the payment of the amount raised, minus the Payment Fees specified below and a commission in favor of PDB equal to 3% including VAT for each payment.

  12. The collection methods take place through Payment Institutions authorized and selected by Pdb.

    In each model, the Supporter shall provide a Donation through payment services offered and managed entirely by PAYPAL, LEMONWAY, or any other payment service provider selected by PDB (referred to as “Manager”), through their own platforms, which constitute market standards. Therefore, in this regard, the Creator releases PDB from any liability. For each payment disbursed, PAYPAL or LEMONWAY retains a fee for the management of the payment service (referred to as “Payment System Fee”), in accordance with its own policies and contractual terms and conditions. Therefore, the Creator receives the amounts disbursed by the Supporters net of said fee. Payment System Fees are determined exclusively by the Manager and, by using credit cards and bank accounts that are within the Euro area, are generally as follows:
    PayPal (Euro area): 3.4% + €0.35 per Donation received, see also https://www.paypal.com/it/webapps/mpp/paypal-fees;
    Lemon Way (Euro area transfers and cards): 0.9% + 0.20€ for each Donation received. .

    FolkFunding s.r.l, through the produzionidalbasso.com platform, is in no way responsible for the Payment System Fees applied by the Manager(s), nor for the possible variations that such costs may undergo over time, limiting its action to providing adequate information to the users of the platform regarding such possible variations.

    Furthermore, in cases where PDB’s service is subject to a fee, PAYPAL or LEMONWAY will also retain said amount on each payment made by Supporters, and disburse it in favor of PDB. In this case, the Creator receives the total of the Donations net of the System Payment Fee and the fee due to PDB:
    - Fee pdb progetti modalità “raccogli tutto”: 5% iva inclusa;
    - Fee PDB for “keep it all” model: 5% VAT included;
    - Fee PDB for “all-or-nothing” model: 5% VAT included (fee applied only if the goal is met or exceeded); - Fee PDB “donation” model: 3% VAT included. Fees are due for each Donation.

    PAYPAL and LEMONWAY and PDB will issue due accounting documents related to the relevant receipts and made out to the legal beneficiary of the service, as required by law.

    Revocation of a Donation: if a Supporter decides to revoke a Donation that has already been properly processed through their banking institution (chargeback), the Creator will be required to re-credit any shortfall against the platform.

    Normally, a Supporter who supports a project by Bank Debit (SDD/RID) or Credit Card through the “Lemon Way” payment system cannot ask the platform to cancel a Donation that has already been properly processed/debited, however, they could make such a request by directly contacting their banking institution to generate a “chargeback” (donation reversal).
    The procedure requires that the bank first withdraw the funds directly from the platform’s business bank account, for this reason, should this occur PDB will notify the Creator who will be required to return the amount - in addition to a fee of €30 per single chargeback - within 30 days of the first communication of said occurrence.
    PDB will provide an accounting document to proceed with the refund. In the event that the Creator has not yet transferred the amounts collected with Lemon Way, it is possible to proceed with the chargeback of this shortfall by transferring the funds in the virtual wallet.

  13. Some models include the possibility of offering Rewards in exchange for donations that are managed independently and under the full responsibility of the Creator

    In exchange for Donations regarding their Project, the Creator may offer rewards to the public.
    Such Rewards may consist of items or services of modest value, however, less than the value of the contribution received. Under no circumstances may Rewards consist of cash or goods or services as referred to in Article 6. The offer of Rewards makes crowdfunding subject to the discipline of conditional donations, indicated by art. 793 of the Civil Code. Therefore the Creator acknowledges that they have a fulfillment obligation, i.e., to deliver the Reward, within the value limits of the cash Donation received.

  14. The Project must clearly indicate the type and quality of the Reward; where clothing is involved, the Creator must clearly indicate available sizes and colors.

    The Creator agrees to provide Rewards to Supporters of no less quality than the Rewards represented and offered in the Project, and in any event to fulfill all commitments made in promises concerning Rewards.
    The Reward promise shall not be deceptive, specious, false or unfeasible.
    Unless otherwise clearly stated in the Project, the Creator agrees to promptly send the Reward to the Supporter, or otherwise meet the deadlines published in the Project.

  15. In the event that the Reward is in the form of a Product Pre-Order, the Creator agrees to proper order processing and fulfillment and to comply with all tax obligations

    As an alternative to Rewards, the Creator may offer the purchase of a future asset, which has yet to be produced, the production of which depends on the collection of a certain number of orders, specifically indicated by Creator. The attainment of such a number of orders is thus a condition precedent suspending the effectiveness of the offer.
    Upon the occurrence of the condition precedent, the Creator must proceed without delay to perform the operations necessary for the promised good or service to be produced.
    The Creator undertakes to use all the sums collected through the Project for the production of the offered good or service, being able to allocate what will remain for other purposes only after fulfilling all orders received.
    Notwithstanding the provisions of Article 1472 of the Civil Code, ownership over the proposed goods does not transfer to the Supporter at the moment it is created, but at the moment it is delivered to the Supporter at the indicated shipping address. Consequently, until delivery all risk on the asset rests with Creator and not with Supporter. Any accounting, fiscal and administrative fulfillment inherent to the orders received is the sole responsibility and competence of Creator, who will therefore promptly provide for invoicing, declarations, certifications and anything else required by current law.

  16. All projects must comply with the models and the rules required by the platform

    The Creator, along with their Supporters, agrees to adopt the Standard Terms and Conditions required by PDB. Any deviating contract conditions must be approved by PDB in writing. PDB reserves the right to change the services or the conditions under which they are rendered with at least fifteen days’ notice.

  17. For all projects compliant with the platform’s models, the Creator agrees to fulfill all tax obligations and to consult with their accountant to verify the tax relevance of the donations collected

    Any accounting, tax and administrative fulfillment inherent to the Donations received is the exclusive competence and responsibility of the Creator, who will therefore promptly provide invoices, declarations, certifications and anything else required by current regulations.

  18. In order to enable the correct conduct of fundraising activities on PDB, in some cases documentation will be required to proceed with Anti-Money Laundering verification as required by current law. The payment institutions involved are responsible for proper profile verification and record keeping

    I pagamenti da parte dei sostenitori sono effettuati mediante gestori di servizi di pagamento regolarmente autorizzati sulla base della disciplina vigente; ove siano disponibili più gestori, la scelta spetterà al sostenitore.
    I gestori trasferiscono al Progettista le somme ricevute al netto delle loro commissioni per il servizio di pagamento. Alcuni gestori di servizi di pagamento provvedono direttamente ed automaticamente a trattenere anche le commissioni dovute dal Progettista a PDB e a trasferirle direttamente a PDB in nome e per conto del Gestore.
    PDB collabora con i gestori dei servizi di pagamento soltanto nella raccolta di informazioni e documenti necessari per l’identificazione e richiesti dalla normativa antiriciclaggio, ma ogni responsabilità inerente la gestione dei servizi di pagamento è esclusivamente del gestore. Per utilizzare i servizi di pagamento (e trasferire il denaro raccolto con LemonWay) è indispensabile fornire le informazioni ed i documenti richiesti dal gestore e superare le verifiche anti-riciclaggio; tra i documenti da fornire al gestore ed aggiornati al seguente link, tramite i tool predisposti da PDB e attraverso l’invio via email (help@produzionidalbasso.com), vi sono:

    1. for individuals:

      • official bank document (e.g., bank statement or homebanking screenshot with the following information visible: bank logo, iban, name of account holder)

      • valid identity document (identity card or color passport). If a citizen outside the EU area, a second valid identity document;

    2. for companies:

      • up-to-date Chamber of Commerce Registration Report;

      • a description of the company’s activity (stamped articles of association);

      • the company’s articles of association with a statement from the governing body confirming that they are the latest current version of the articles of association;

      • proof of identity of the sole director or managing director, as provided for individuals;

      • any identity documents of shareholders having > 25% of the company;

      • official bank document (e.g., bank statement or homebanking screenshot with the following information visible: bank logo, iban, name of account holder - the company)

    3. for other organizations (associations, NGOs, clubs, etc.):

      • a description of the organization's activities;

      • a copy of the signed and stamped articles of incorporation and bylaws;

      • the organization’s tax identification number, if one has been assigned;

      • signed minutes of recent meeting (no more than 6 months prior);

      • the organization’s bylaws with a statement from the governing body confirming that they are the latest current version of the bylaws;

      • proof of identity as provided for individuals;

      • official bank document (e.g., bank statement or homebanking screenshot with the following information visible: bank logo, iban, name of account holder - the association);

    A partire dal 1 Novembre 2024 per completare la procedura è richiesta anche la compilazione di un questionario di conformità mediante un formulario Typeform predisposto da Lemon Way e diverso a seconda del profilo creato.

  19. The Produzioni dal Basso platform may be subject to graphic changes

    PDB reserves the right to change, without notice, layout, graphics, size, colors of the Site and the pages on which the Project is presented. It also reserves the right to insert, add, modify and otherwise manage completely autonomously the spaces of said pages, adding, removing, superimposing information, communication, advertisements, images, banners and any content it deems appropriate. PDB agrees to advertise on its website the Project on equal terms with other projects purchasing the same class and type of services.

  20. The Creator authorizes PDB to use images and material published on its pages (non-exclusively)

    In return for the services received, in addition to the economic compensation for the various services, the Creator grants PDB a royalty-free, irrevocable, and time-limited license to use its logo, image, content, and each page of the Project, including images and videos. This license may be used by PDB for promotional, educational, analysis or research purposes and may be extended to partners, collaborators, communication agencies, research institutions, at PDB’s sole discretion. Where the above rights are owned by third parties, it shall be the sole responsibility of Creator to obtain the transfer of licenses in favor of PDB as provided in this paragraph.

  21. The contract between Creator and PDB is signed online and is subject to the jurisdiction of Italy

    This contract is subject to Italian jurisdiction. The Parties agree that any dispute concerning the interpretation or performance of this contract and all associated services shall be submitted exclusively to a three-member arbitration panel, which shall adjudicate according to law in a ritual manner. Each Party may appoint one arbitrator, while the third, acting as Chairman of the Board, shall be appointed by the two arbitrators.
    In the absence of the appointment of a party arbitrator within 20 days of the commencement of the procedure or in the absence of agreement on the appointment of the Chairman of the Board, appointments will be made by the President of the Court of Rome at the request of the most diligent Party. The Arbitration Board will decide with an award to be filed within sixty days of the establishment of the Board.

  22. A Creator who applies for membership to a Network (and is accepted) surrenders, anonymously, the statistical data of their project in favor of the Network

    When a Creator requests to join a Network, and that request is granted, the project’s statistical data will be transferred anonymously and in aggregate to the Network itself. Under no circumstances is it possible to trace the sensitive and/or personal data of individual users in order to figure out which donor and/or project they are connected to. Under no circumstances will the personal data or email addresses of supporters be transferred to the owner of the Network, except for the possibility on the part of the Network to send information or communications to all supporters of projects associated with its Network and/or affiliated Creators through computer tools, made available by FolkFunding s.r.l. through the produzionidalbasso.com platform, which does not allow access to the individual email addresses of recipients by the Network.

3. Terms and conditions for those who support a project

Produzioni dal Basso is an open, horizontal and transparent platform

Since 2005 PDB has been a crowdfunding site that allows fundraising for specific projects by anyone who wants to support them, horizontally, transparently, and completely free of charge to the Supporter.

Before creating your project on PDB you must read and agree to the following terms of use.

PDB offers the possibility to support different types of crowdfunding whose conditions are significantly different; Supporters should check exactly what is offered, the existence of rewards or counter-rewards, and the terms and conditions of the project.

PDB does not intermediate, does not receive percentages from Supporters, does not acquire rights to proposed works, does not promote projects, and does not distribute anything.
Consequently, PDB assumes no responsibility for the projects submitted on the platform; PDB is merely a service provider for Creators of a project and those who intend to fund it: Supporters.
Therefore, all Supporters are invited to carefully evaluate the proposed project, choosing independently whether and how to support it, possibly asking for expert advice. In addition, all Supporters are invited to participate in community activities, sharing ideas, considerations and comments on each proposed project.

To support a project one must register with a valid e-mail, the information requested is intended to allow an economic transaction within the terms of the law and to give the correct information to the Creator to contact Supporters and/or send the promised rewards

To support a project, simply register on the site using a valid email and password. Then you will be guided through the funding process and the conclusion of the agreement with the Creator. No contractual relationship is created between PDB and supporters, but only between Supporters and Creators. Execution of a donation entails full and complete acceptance of the terms and conditions offered by the Creator, in the version in effect at the time of funding.

For certain amounts, the Supporter is asked to provide more information according to anti-money laundering law

Some forms of payment require the collection of information on the basis of anti-money laundering law and current arrangements. In such cases, the person in charge of the payment service is the Manager chosen by the supporter, duly authorized to operate by the supervisory authorities. PDB shall cooperate in the execution of the service, collecting data and documents required by current law and forwarding them to the Manager, who is solely responsible for the execution of the service. The Supporter provides the donation through the payment services offered and managed entirely by PAYPAL or LEMONWAY (or any other payment service provider identified by PDB), through its own platforms, which are market standards. In some cases it is possible that the operator may charge the Supporter fees. For terms and conditions of payment services, check the provisions of the Managers on the relevant pages.

Donation with deferred payment over time credit card/PayPal with “all or nothing“ fundraising model

If you participate in a campaign proposed in the “all or nothing“ model at the time of subscription, the Manager of the pre-selected payment services (PayPal or Lemon Way), can arrange for verification of the existence of the funds with the Supporter, but not for the actual debiting of their account or booking of the expense. However, the Supporter commits to settle the pledge upon the occurrence of certain conditions.

If the Goal is not reached by the Deadline, the Creator is not entitled to any payment and all Donations become ineffective.

Where at the expiration of the Deadline the Goal has been reached or exceeded, the Creator is entitled to the payment of the pledged amounts.

Where the Supporter's bank account has become incapacitated, no funds will be credited to the Creator or fees charged to anyone. The system will send reminders to the defaulter.

A Supporter who fails to settle the Donation using the previously authorized method of payment has the option to update the payment method or change it and settle the Donation.
